Security Decree: New Obligations and Opportunities for Businesses

New measures have been introduced to strengthen health and safety protections in the workplace.
Decree-Law No. 159 of 31 October 2025 – known as the Security Decree – introduces more targeted inspections, financial incentives, and a strong push toward the digitalization of corporate processes related to prevention.

These changes send a clear message: safety is no longer merely a legal obligation, but a key indicator of reliability and sustainability for businesses.

Among the most significant innovations is the introduction of a digital identification card for workers employed in construction sites and high-risk sectors.
The card, equipped with a unique code and anti-counterfeiting features, will be connected to the SIISL platform and will allow for the immediate verification of each worker’s identity and employment status.

From a legal standpoint, this measure strengthens the employer’s responsibility to ensure that only duly employed and trained personnel are authorized to operate on site.
It represents an important step toward greater traceability but will require careful management of data flows and privacy protection.

As a result, the Decree also enhances inspections concerning contracts and subcontracting arrangements, shifting the focus to the entire supply chain.
It is no longer sufficient for each company to “do its part”; shared responsibility among all stakeholders is now required.

Another key innovation concerns INAIL incentives, which from 2026 may be adjusted based on a company’s accident rate.
Businesses that demonstrate effective prevention measures will be eligible for contribution bonuses, while those convicted of serious violations will be excluded from these benefits.

Starting in 2026, in order to access contribution reductions or other financial incentives, employers will be required to publish their job offers on the SIISL platform.
