Artificial Intelligence and Work: the Guidelines of the Ministry of Labour

The use of Artificial Intelligence in workplace contexts has become a structural phenomenon, set to have a significant impact on corporate organization and on the relationship between employers and employees.

Precisely in order to govern this transformation, the Ministry of Labour and Social Policies, by Ministerial Decree No. 180 of 17 December 2025, adopted the Guidelines for the Implementation of Artificial Intelligence in the World of Work.

This regulatory initiative aims to promote a conscious and responsible adoption of new technologies, capable of reconciling innovation, business competitiveness, and the protection of workers’ rights, in compliance with the existing legal framework.

The Guidelines are structured around three main pillars.

First, emphasis is placed on training and skills development, which are considered essential to enable workers to face the changes introduced by AI with greater confidence and to seize the new professional opportunities it offers.

A second pillar concerns the protection of workers, with particular attention to the prevention of discrimination, the protection of personal data, and the requirement that AI systems always operate under human supervision, ensuring transparency and accountability in corporate processes.

Finally, the Ministry highlights the need to reduce the digital divide by promoting equitable access to innovation and preventing new forms of exclusion, especially with regard to more vulnerable groups.

Particular attention is devoted to the use of AI in corporate decision-making processes, such as recruitment, performance evaluation, and work organization. Intelligent technologies may support decision-making but must never replace human judgment or become instruments of invasive control over work activities.

The Guidelines therefore represent an initial operational reference point for companies and professionals, outlining a balance between technological progress and the safeguarding of the individual in the workplace.
