The Consolidated Labour Safety Act (D.lgs. 81/2008) is a fundamental pillar for the protection of health and safety at the workplace in Italy.
The Text has recently been updated to strengthen existing regulatory provisions by introducing new measures. In this article we want to indicate the innovations introduced, which concern the following areas:
Qualification of firms and points licence:
One of the most significant innovations concerns the qualification system for enterprises and self-employed workers, a subject we have already dealt with in a previous article, and which now provides for a system of credits through the “credit licence for yards“.
This measure, introduced by the D.M. 18 September 2024, n. 132, aims to improve the control on the skills and professionalism of operators in the sector. The relevant penalty regime, outlined in note INL number 9326 of 9 December 2024, has been designed to encourage continuous training and updating, thus contributing to greater safety in the workplace.
Risk management of carcinogens and mutagens:
Relevant is the updating of risk management for carcinogens and mutagens. With the transposition of Directive (EU) 2022/431, the D.lgs. 4 September 2024, n. 135, which establishes mandatory biological limit values and procedures for health surveillance. These new provisions represent a step forward in protecting the health of workers exposed to such risks.
Annual Safety Report:
The Budget Law 2025 (Law n. of 28 December 2024), which came into force on 12 January 2025, introduced a new article 14-bis, providing for an annual report on the state of safety in the workplace. This measure is intended to improve the transparency and accountability of companies in safety matters by providing a clear and up-to-date picture of the situation.
Clarifications and operating instructions:
In addition to the legislative changes, important interpretative clarifications were provided through questions and ministerial notes. These clarifications relate to critical aspects of the legislation, such as the appointment of the Workers’ Safety Representative (RLS), updating and training of supervisors. The note of the Ministry of Labour and Social Policies, number 14843 of 20 November 2024, updated the fees for periodic inspections of work equipment.
Agreements of the State-Regions Conference:
Finally, several agreements of the State-Regions Conference have been recalled and updated, including the Rep. 2540 agreement of 16 March 2006, which defines the work activities with a high risk of accidents for which the administration of alcoholic beverages is prohibited, and the Rep. 178/CSR agreement of 18 July 2008 on procedures for ascertaining the absence of drug addiction or drug intake in workers exposed to specific risks.
