{"id":29759,"date":"2021-03-24T09:51:51","date_gmt":"2021-03-24T08:51:51","guid":{"rendered":"https:\/\/allavellilegal.com\/?p=29759"},"modified":"2024-09-16T16:38:10","modified_gmt":"2024-09-16T14:38:10","slug":"fixed-term-contracts-the-decreto-sostegni-confirms-the-extension-without-condition-until-31-december-2021","status":"publish","type":"post","link":"https:\/\/allavellilegal.com\/blog\/en\/fixed-term-contracts-the-decreto-sostegni-confirms-the-extension-without-condition-until-31-december-2021\/","title":{"rendered":"Fixed-Term Contracts: The \u201cDecreto Sostegni\u201d Confirms the Extension without condition Until 31 December 2021"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The \u201c<\/span><b>Decreto Sostegni<\/b><span style=\"font-weight: 400;\">\u201d brings to the end of the year the right to extend the fixed term contract even in the absence of the condition (DL 41\/2021, art 17, which replaced paragraph 1 of art. 93 DL 34\/2020).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is therefore possible <\/span><b>until December 31, 2021 to renew or extend for a maximum period of twelve months and only once &#8211; fixed-term employment contracts, even in the absence of the conditions<\/b><span style=\"font-weight: 400;\"> set out in art.\u00a0\u00a019, paragraph 1, Legislative Decree 81\/2015.<\/span><\/p>\n<p><b>All this without prejudice to the maximum overall duration of twenty-four months.\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The epidemiological emergency from COVID-19 pushes the Legislator, through the favorable opinion of the <\/span><a href=\"https:\/\/www.lavoro.gov.it\/temi-e-priorita\/rapporti-di-lavoro-e-relazioni-industriali\/focus-on\/Disciplina-rapporto-lavoro\/Pagine\/contratto-a-tempo-determinato.aspx\"><span style=\"font-weight: 400;\">Ministry of Labor<\/span><\/a><span style=\"font-weight: 400;\">, to allow a temporary derogation from the discipline of fixed-term contracts (pursuant to Article 21 of Legislative Decree 81\/2015).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Please note that, in the absence of emergency legislation, the maximum duration of the term contract is set at twelve months and can be extended to twenty-four months only in the presence of at least one of the following conditions (19, paragraph 1, Legislative Decree 81\/2015):<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">temporary and objective needs, unrelated to ordinary activities;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">necessarily replacement of other workers;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">requirements related to temporary, significant and non-programmable increases in ordinary activity.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Definitely a (albeit meager) incentive not to interrupt the temporary contract.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But certainly not decisive in the medium to long term.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Allavelli Legal<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The \u201cDecreto Sostegni\u201d brings to the end of the year the right to extend the fixed term contract even in the absence of the condition (DL 41\/2021, art 17, which replaced paragraph 1 of art. 93 DL 34\/2020).
