{"id":29781,"date":"2021-04-02T10:51:02","date_gmt":"2021-04-02T08:51:02","guid":{"rendered":"https:\/\/allavellilegal.com\/?p=29781"},"modified":"2024-09-23T17:30:19","modified_gmt":"2024-09-23T15:30:19","slug":"italian-economic-redundancies-mandatory-reinstatement-if-the-fact-is-manifestly-non-existent","status":"publish","type":"post","link":"https:\/\/allavellilegal.com\/blog\/en\/italian-economic-redundancies-mandatory-reinstatement-if-the-fact-is-manifestly-non-existent\/","title":{"rendered":"Italian economic redundancies: \u2018Mandatory\u2019 reinstatement if the fact is manifestly non-existent"},"content":{"rendered":"<p>In the context of the (well known)\u00a0<strong>art. 18 of the Workers\u2019 Statute<\/strong>\u00a0(L. 300\/1970), the peremptory \u201capply\u201d of the first sentence of the seventh paragraph was in contrast with the \u201ccan apply\u201d of the second sentence.<\/p>\n<p>This implies, according to the proper meaning of the words, a discretionary faculty of the judge.<\/p>\n<p>&nbsp;<\/p>\n<p>The\u00a0<strong>\u2018attenuated\u2019 reinstatement protection<\/strong>, therefore, was subject to the\u00a0<strong>discretionary assessment of the Judg<\/strong>e with respect to the \u201cnot excessive onerousness of the remedy\u201d (Court of Cassation, Labor Section, judgment January 31st 2019, n. 2930).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Italian Constitutional Court sentence\u00a0<\/strong><\/p>\n<p>With Sentence no. 59\/2021, the Italian Constitutional Court declares the\u00a0<strong>constitutional illegitimacy<\/strong>\u00a0of art. 18, seventh paragraph, second sentence, of the Workers\u2019 Statute\u00a0<strong>in the part in which it provides that, when the judge ascertains the manifest non-existence of the fact based on the dismissal for justified objective reason, he \u201ccan apply\u201d instead of \u201capply\u201d the reinstatement protection attenuated<\/strong>\u00a0(fourth paragraph of the same art. 18).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The motivation<\/strong><\/p>\n<p>The contested provision, in establishing a\u00a0<strong>discretionary right<\/strong>\u00a0to grant or deny reinstatement,\u00a0<strong>was in contrast with art. 3 of the Italian Constitution<\/strong>.<\/p>\n<p>The purely optional character of reintegration revealed a disharmony within the peculiar system outlined by the law violated the principle of equality.<\/p>\n<blockquote><p>In particular, the principle of equality is violated if, in the event of economic dismissals, reinstatement is provided as optional \u2013 while it is mandatory in dismissals for just cause and justified subjective reason \u2013 when the fact that caused them is manifestly non-existent.<\/p>\n<p style=\"text-align: right;\">Constitutional Court<\/p>\n<\/blockquote>\n<p>A different treatment reserved for economic dismissals is not justified (and nevertheless the more incisive connotation of the non-existence of the fact, indicated by the legislator as \u201d manifest \u201d).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The \u2018attenuated\u2019 reinstatement protection<\/strong><\/p>\n<p>The attenuated reinstatement protection provides for reintegration into the workplace, like the \u2018full\u2019 reintegration protection, but limits to twelve months the amount of compensation that the employer is obliged to pay.<\/p>\n<p>From this amount, however, must be deducted not only what the worker has earned by virtue of other occupations (<em>aliunde perceptum<\/em>), but also what he could have earned by working with ordinary diligence searching for another job (<em>aliunde percipiendum<\/em>).<\/p>\n<p>Also in this case, the worker has the right \u2013 specifically exercised in the main proceedings \u2013 to opt for the indemnity in lieu of reinstatement.<\/p>\n<p>This protection applies to disciplinary dismissals, for just cause or justified subjective reason.
