{"id":29799,"date":"2021-04-28T20:12:22","date_gmt":"2021-04-28T18:12:22","guid":{"rendered":"https:\/\/allavellilegal.com\/?p=29799"},"modified":"2024-09-23T17:05:48","modified_gmt":"2024-09-23T15:05:48","slug":"brexit-applicable-legislation-to-the-posted-employee","status":"publish","type":"post","link":"https:\/\/allavellilegal.com\/blog\/en\/brexit-applicable-legislation-to-the-posted-employee\/","title":{"rendered":"BREXIT: applicable legislation to the posted employee"},"content":{"rendered":"<p>EU \/ UK Trade and Cooperation Agreement (&#8220;TCA&#8221;) is applicable from January 1th, 2021 (term extended to April 30, 2021 with decision no. 1 of 23 February 2021 of the Partnership Council).<\/p>\n<p>This agreement defines the legislation applicable to the case of EU \/ UK employees posting.<\/p>\n<p>With <a href=\"https:\/\/servizi2.inps.it\/Servizi\/CircMessStd\/VisualizzaDoc.aspx?sVirtualUrl=\/circolari\/Circolare%20numero%2071%20del%2027-04-2021.htm\">Circular no. 71 of April 27, 2021<\/a>, the INPS (Italian Social Security Service) provides specific information.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>General criterion (Art. SSC.10)<\/strong><\/p>\n<p>A person who works in a State is subject to the legislation of that State (where employer has its legal office\/workplace).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Exemption for posted employees (Art. SSC.11)<\/strong><\/p>\n<p>Posted employees remain subject to the legislation of the original state if:<\/p>\n<ul>\n<li>The duration of the posting does not exceed 24 months<\/li>\n<li>The posting does not take place to replace another previously posted worker<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Memberships<\/strong><\/p>\n<p>The EU must notify to UK the list of States that:<\/p>\n<ul>\n<li>Category A: accepts the exemption<\/li>\n<li>Category B: does not accept the exemption<\/li>\n<li>Category C: does not send any response<\/li>\n<\/ul>\n<p>Please note that the Italian Labor Ministry has asked for the inclusion of Italy in category A.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Posting in two or more states (Article SSC.12)<\/strong><\/p>\n<p>Employee posted in several countries (EU and UK) is subject to:<\/p>\n<ol>\n<li>Legislation of the state of residence if she\/he exercises most of the activity there<\/li>\n<li>Otherwise (in general) the legislation of the State where the employer has its registered office\/workplace<\/li>\n<\/ol>\n<p>Employee posted to multiple countries (EU only) is subject to UK legislation if:<\/p>\n<ul>\n<li>Employer has its registered office in the UK<\/li>\n<li>The employee resides in the UK and the employer is based outside the EU<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>EU \/ UK Trade and Cooperation Agreement (&#8220;TCA&#8221;) is applicable from January 1th, 2021 (term extended to April 30, 2021 with decision no. 1 of 23 February 2021 of the Partnership Council).
