{"id":29834,"date":"2021-06-08T19:17:20","date_gmt":"2021-06-08T17:17:20","guid":{"rendered":"https:\/\/allavellilegal.com\/?p=29834"},"modified":"2024-09-23T16:43:31","modified_gmt":"2024-09-23T14:43:31","slug":"italian-subcontracting-the-news-of-the-simplification-decree","status":"publish","type":"post","link":"https:\/\/allavellilegal.com\/blog\/en\/italian-subcontracting-the-news-of-the-simplification-decree\/","title":{"rendered":"Italian Subcontracting: The News of the &#8216;Simplification Decree&#8217;"},"content":{"rendered":"<p>Another change in terms of italian subcontracting.<\/p>\n<p>The &#8216;Simplification Decree&#8217; (Art. 49 DL 77\/2021) modifies, temporarily (for now), the legal discipline of the subcontracting regime.<\/p>\n<p>Starting from the current month of June here is the news.<\/p>\n<p><strong>Until October 31, 2021, the subcontract cannot exceed 50% of the total amount (currently it is 30%).<\/strong><\/p>\n<p>The full transfer \/ execution of the contract to third parties is still prohibited, as well as the prevalent execution of labor-intensive processes.<\/p>\n<p>The subcontractor must guarantee the same <strong>quality standards<\/strong> and grant workers an <strong>economic and regulatory treatment<\/strong> not inferior to the previous one.<\/p>\n<p><strong>From 1 November 2021, all quantitative limits on subcontracting are removed.<\/strong><\/p>\n<p>The contracting authorities will indicate <strong>in the tender documents<\/strong>:<\/p>\n<ul>\n<li>the services that must be<strong> compulsorily performed by the contractor<\/strong><\/li>\n<li>the necessary works to strengthen control, protection and safety of workers<\/li>\n<li>how to prevent the risk of criminal infiltration (unless subcontractors are registered in the white list or in the anti-mafia registry)<\/li>\n<\/ul>\n<p>The main contractor and the subcontractor are in any case jointly and severally liable towards the contracting authority.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Another change in terms of italian subcontracting.
