{"id":29838,"date":"2021-06-14T19:31:51","date_gmt":"2021-06-14T17:31:51","guid":{"rendered":"https:\/\/allavellilegal.com\/?p=29838"},"modified":"2024-09-23T16:40:05","modified_gmt":"2024-09-23T14:40:05","slug":"italian-freezing-of-redundancies-still-uncertainties","status":"publish","type":"post","link":"https:\/\/allavellilegal.com\/blog\/en\/italian-freezing-of-redundancies-still-uncertainties\/","title":{"rendered":"Italian Freezing of Redundancies: still uncertainties"},"content":{"rendered":"<p>Uncertainties remain on the future of the Italian freezing of redundancies.<\/p>\n<p>The government is currently evaluating various hypotheses.<\/p>\n<p>The \u201cDecreto Sostegni\u201d, currently, extends the prohibition on dismissal (paragraphs 9 and 10, art.8, DL 41\/2021):<\/p>\n<ul>\n<li><strong>till June 30th 2021<\/strong> for workers of companies with ordinary and extraordinary CIG (especially industry and agriculture)<\/li>\n<li><strong>till October 31st 2021<\/strong> for workers of companies covered by instruments in derogation (especially tertiary sector)<\/li>\n<\/ul>\n<p>The following are still excluded from the prohibition:<\/p>\n<ul>\n<li><strong>corporate collective agreement<\/strong><\/li>\n<li>expansion contract<\/li>\n<li>reinstatement for <strong>change of contract<\/strong><\/li>\n<li><strong>bankruptcy<\/strong><\/li>\n<li>definitive <strong>termination<\/strong> of the company&#8217;s business (which does not involve the transfer of a company or one of its branches)<\/li>\n<li><strong>just-cause dismissa<\/strong>l<\/li>\n<li>dismissal for <strong>disciplinary<\/strong> reasons<\/li>\n<li>dismissal for exceeding the grant period of illness<\/li>\n<li>dismissal for failure to pass the <strong>probationary period<\/strong><\/li>\n<li>dismissal for reaching age for the use of the <strong>old-age pension<\/strong><\/li>\n<li>dismissal for <strong>unfitness for duties<\/strong><\/li>\n<li>dismissal of the <strong>domestic worker<\/strong><\/li>\n<li>dismissal of the <strong>manager<\/strong> (<a href=\"https:\/\/allavellilegal.com\/blocco-licenziamenti-esteso-anche-ai-dirigenti\/\">even if a recent jurisprudential orientation is contrary<\/a>)<\/li>\n<li>the termination of the <strong>apprenticeship<\/strong> at its expiration date<\/li>\n<li><strong style=\"font-size: 1rem;\">consensual<\/strong><span style=\"font-size: 1rem;\"> employment terminations and <\/span><strong style=\"font-size: 1rem;\">resignations for just cause<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Uncertainties remain on the future of the Italian freezing of redundancies.
