{"id":29922,"date":"2021-11-01T18:40:47","date_gmt":"2021-11-01T17:40:47","guid":{"rendered":"https:\/\/allavellilegal.com\/?p=29922"},"modified":"2024-09-23T15:28:57","modified_gmt":"2024-09-23T13:28:57","slug":"italian-freezing-of-redundancies-the-never-ending-story","status":"publish","type":"post","link":"https:\/\/allavellilegal.com\/blog\/en\/italian-freezing-of-redundancies-the-never-ending-story\/","title":{"rendered":"Italian freezing of redundancies: the never ending story"},"content":{"rendered":"<p><strong>Italian \u201cFiscal Decree\u201d extends again the prohibition of dismissal until 31 December 2021 <\/strong>(Article 11, Legislative Decree 146\/2021).<\/p>\n<p><strong>Not generalized <\/strong>but intended <strong>only for companies that use the social bumpers provided and only for the relevant period<\/strong>:<\/p>\n<ul>\n<li>Employers who access ordinary and \u2018cassa in deroga\u2019 check (Maximum thirteen weeks; No additional contribution);<\/li>\n<li>Employers with ATECO code 13, 14 and 15 (Maximum nine weeks; No additional contribution).<\/li>\n<\/ul>\n<p>In any case, while the block is in effect,<strong> it is always possible<\/strong> to terminate the employment relationship in the following cases:<\/p>\n<ul>\n<li>corporate collective agreement;<\/li>\n<li>expansion contract;<\/li>\n<li>reinstatement for change of contract;<\/li>\n<li>bankruptcy;<\/li>\n<li>definitive termination of the company\u2019s business (which does not involve the transfer of a company or one of its branches);<\/li>\n<li>just-cause dismissal;<\/li>\n<li>dismissal for disciplinary reasons;<\/li>\n<li>dismissal for exceeding the grant period of illness;<\/li>\n<li>dismissal for failure to pass the probationary period;<\/li>\n<li>dismissal for reaching age for the use of the old-age pension;<\/li>\n<li>dismissal for unfitness for duties;<\/li>\n<li>dismissal of the domestic worker;<\/li>\n<li>dismissal of the manager (even if a recent jurisprudential orientation is contrary);<\/li>\n<li>the termination of the apprenticeship at its expiration date;<\/li>\n<li>consensual employment terminations and resignations for just cause.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Italian \u201cFiscal Decree\u201d extends again the prohibition of dismissal until 31 December 2021 (Article 11, Legislative Decree 146\/2021).
